Agreement to Terms
By accessing our website www.yourpowerfulpauses.com or engaging with any services offered by Powerful Pauses LLC (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Powerful Pauses LLC.

Eligibility
You must be at least 21 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement.

Services Provided
Powerful Pauses LLC provides life coaching services designed for women over 40 who seek greater clarity, energy, and connection with their authentic selves. Our services include:

One-on-one coaching sessions
Digital resources (where applicable)
Access to proprietary AI-powered reflection tools built by Powerful Pauses LLC
Email support and guidance
Community access (where applicable)
Nature of Coaching Services
Life coaching is not therapy, counseling, or mental health treatment. Our services are designed to help you:

Gain clarity about your goals and values
Develop actionable strategies for personal growth
Build confidence and self-awareness
Create sustainable habits and routines
If you are experiencing mental health concerns, crisis situations, or need therapeutic support, we strongly recommend seeking services from a licensed mental health professional.

AI-Enhanced Coaching Tools
Our programs include access to proprietary AI-powered tools that we’ve built using the Dust.tt platform. These custom tools are designed specifically to support our coaching methodology and help you organize your reflections between sessions.

Important Disclaimers:

You are receiving access to our custom-built AI tools, not the Dust platform itself
AI tools summarize and organize your responses; they do not generate coaching advice
The content you create using these tools is for your personal review and reflection
You are responsible for how you interpret and apply your own insights
Your coach provides guidance on how to use these tools effectively
AI tools are not designed to handle crisis situations or mental health emergencies
Enrollment and Payment
Program Registration
When you enroll in a coaching program:

You will receive a separate coaching agreement detailing program specifics
Payment is processed securely through our payment processor (Paperbell/Stripe)
Enrollment is confirmed upon receipt of payment or first installment
Pricing and Fees
All prices are listed in USD
Prices are subject to change; you will be charged the price in effect at the time of enrollment
Payment plans may be available for certain programs
Late payment fees may apply to missed installment payments
Refund Policy
30-Day Clarity & Energy Sprint and Other Programs:

If you cancel within 7 days of enrollment AND before the program officially begins, you are eligible for a full refund minus a $97 administrative fee
Once the program begins (first coaching session), refunds are not available
You remain responsible for any outstanding payment plan installments
Refund requests must be submitted in writing to hello@yourpowerfulpauses.com
Digital Products and Lead Magnets:

Due to the immediate access nature of digital products, all sales are final
No refunds are provided for free lead magnets or resources
Exceptional Circumstances:

In cases of medical emergency or extenuating circumstances, contact us to discuss options
Refund decisions in exceptional cases are at our sole discretion
Client Responsibilities
As a client, you agree to:

Provide accurate and complete information
Actively participate in coaching sessions and exercises
Complete agreed-upon action items between sessions
Communicate openly and honestly with your coach
Notify us immediately if you are experiencing a crisis or mental health emergency (and seek appropriate professional help)
Respect scheduled session times and provide at least 24 hours notice for cancellations
Use AI tools responsibly and in accordance with program guidelines
Missed Sessions and Cancellations
Client-Initiated Cancellations
You must provide at least 24 hours notice to reschedule a coaching session
Sessions cancelled with less than 24 hours notice may be forfeited
Emergency situations will be considered on a case-by-case basis
Rescheduling is subject to coach availability
Coach-Initiated Cancellations
If we need to cancel or reschedule a session, we will provide as much notice as possible
You will be offered a rescheduled session at a mutually convenient time
In the rare event we cannot fulfill our coaching commitment, you will receive a prorated refund
Results and Outcomes
No Guarantee of Results:

Coaching outcomes depend on many factors, including your commitment, effort, and circumstances
We do not guarantee specific results, outcomes, or achievements
Success in coaching requires active participation and implementation
Individual results will vary based on your unique situation and efforts
Client Autonomy:

You are solely responsible for decisions and actions you take as a result of coaching
You have complete autonomy in choosing whether to implement coaching insights
We are not liable for outcomes resulting from your decisions or actions
Confidentiality
Our Commitment
We maintain confidentiality of all information you share during coaching sessions
We will not disclose your personal information without your consent, except as required by law
Group coaching participants are expected to maintain confidentiality regarding others’ shared information
Limitations
We may be required to breach confidentiality in cases of:

Risk of harm to yourself or others
Suspected child abuse or elder abuse
Court orders or legal requirements
Fraud or illegal activity
AI Tool Data
Your Dust account is private to you; your coach does not have access to what you write in Dust
Dust.tt retains data according to their own privacy policy and terms of service
You control your Dust account and can manage your data directly through their platform
We encourage you to review Dust.tt’s privacy policy for their data handling practices
Intellectual Property
Our Content
All content provided through our programs, including but not limited to:

Worksheets and exercises
Email sequences and resources
Video and audio content
Proprietary AI prompts, workflows, and reflection tools
Coaching frameworks and methodologies
…is the intellectual property of Powerful Pauses LLC and is protected by copyright law.

Limited License
You are granted a personal, non-exclusive, non-transferable license to use program materials for your personal growth only. You may not:

Reproduce, distribute, or sell our materials
Share our proprietary AI tools, prompts, or workflows with others
Use our content for commercial purposes
Share login credentials or program access with others
Reverse engineer, copy, or recreate our AI tools or methodologies
Use our AI tools to create competing products or services
Your Content
You retain ownership of any personal reflections, journal entries, or content you create. By using our services, you grant us permission to use anonymized examples or testimonials for marketing purposes (with your explicit consent).

Limitation of Liability
To the fullest extent permitted by law:

Powerful Pauses LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our services
Our total liability shall not exceed the amount you paid for the specific program or service
We are not responsible for technical issues, including AI tool malfunctions or platform downtime
We are not liable for actions you take based on coaching insights or AI-generated content
Indemnification
You agree to indemnify and hold harmless Powerful Pauses LLC, its owner, and affiliates from any claims, damages, or expenses arising from:

Your use of our services
Your violation of these Terms
Your violation of any third-party rights
Any actions you take based on coaching or AI tools
Termination
Your Rights
You may terminate your participation in coaching at any time by providing written notice. Refunds will be governed by our Refund Policy above.

Our Rights
We reserve the right to terminate our coaching relationship if:

You violate these Terms of Service
You engage in abusive, threatening, or inappropriate behavior
You fail to make required payments
We determine that coaching is not appropriate for your needs
Continuing the relationship would be unethical or harmful
Upon termination, you lose access to program materials and resources. Outstanding payment obligations remain due.

NO WARRANTIES:

Our services are provided “as is” without warranties of any kind, express or implied. We do not warrant that:

Our services will meet your specific needs or expectations
Our services will be uninterrupted or error-free
AI tools will always function perfectly
Any particular outcome will be achieved
HEALTH DISCLAIMER:

Our coaching services are not a substitute for professional medical, psychological, legal, or financial advice. Always consult appropriate licensed professionals for such needs.

TECHNOLOGY DISCLAIMER:

While we strive to provide reliable AI tools, technology may occasionally malfunction. We are not responsible for technical failures or data loss.

Changes to Terms
We reserve the right to modify these Terms at any time. We will notify active clients of material changes via email. Continued use of our services after changes constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Dispute Resolution
Any disputes shall first be addressed through good-faith negotiation
If negotiation fails, disputes may be resolved through mediation
Both parties agree to attempt mediation before pursuing litigation
Any legal action must be brought in the courts of New Jersey
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement
These Terms, together with our Privacy Policy and your individual Coaching Agreement, constitute the entire agreement between you and Powerful Pauses LLC regarding our services.
